These are the Terms of Use ("Terms") that apply to your use of the Engage Speak website ("Site") and the services available on the Site ("Services"). By accessing or using our Site and Services, you agree to these Terms. If you do not agree, please discontinue use of the Site. For account deletion and termination, please refer to Section 6: "Modifying and Terminating Our Services." 1. Who May Use the Service

You may use our Services only if you are capable of forming a legally binding contract with Engage Speak, and only in compliance with these Terms and all applicable laws and regulations. When creating your Engage Speak account, and throughout your use of our Services, you must provide accurate, complete, and up-to-date information. You agree to update your information as needed to maintain its accuracy.

2. Feedback

We welcome your suggestions, comments, and other feedback regarding our classes ("Feedback"). By submitting Feedback (for example, after a completed session), you grant Engage Speak a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, modify, publish, and incorporate that Feedback into our services and operations without compensation or acknowledgment. The submission of Feedback does not limit Engage Speak’s right to use similar ideas or suggestions already known to us, or obtained from other sources.

3. Security

While we take reasonable steps to protect the security of your account and personal information, Engage Speak cannot guarantee that unauthorized third parties will never be able to defeat our security measures. You are responsible for maintaining the confidentiality of your account credentials. Please notify us immediately at [email protected] if you suspect any unauthorized access or use of your account.

4. Payment of Fees

Access to certain Services may require payment. You agree to pay all applicable fees and charges associated with your use of the paid Services in accordance with our pricing and payment terms. Refunds may be available as outlined in our Refund and Cancellation Policy. It is your responsibility to review the refund terms before making any payment. Failure to comply with payment obligations may result in suspension or termination of your access to the Services.

5. User Conduct and Account Termination

Engage Speak is committed to providing a respectful and professional learning environment for both students and teachers. Any form of misconduct, including abusive language, harassment, or disrespectful behavior towards instructors or staff, may result in immediate suspension or termination of your account and access to services.

We reserve the right to cancel your current or future classes and terminate your subscription without refund if you engage in behavior that violates these Terms or disrupts the learning experience of others.

6. Modifying and Terminating our Services

We are continuously working to improve and evolve Engage Speak’s Services. As part of this process, we may introduce new features, update existing ones, or remove certain functionalities. We also reserve the right to modify, suspend, or discontinue any part of our Services at any time, either temporarily or permanently, with or without notice.

If you wish to terminate your own account, you may do so at any time:

• If you never subscribed, email us at [email protected]. Your account will be deleted within 3 business days.
• If you currently have or previously had a subscription, you can delete your account directly through your profile settings.

If we terminate or restrict your access to a paid Service for reasons other than a violation of our Terms of Use, you may be eligible for a refund as outlined in our Refund and Cancellation Policy.

7. Class Scheduling/Rescheduling and Attendance

Engage Speak provides personalized 1-on-1 English-speaking classes. By booking and attending sessions, you agree to the following:

• Each teacher has different availability, and you can view their available slots when selecting a teacher. Teachers may change based on availability.
• If your assigned teacher is unavailable due to illness or emergency, we reserve the right to assign a qualified substitute teacher.
• Each class is 25 minutes long. If you join late, the class will still end at the scheduled time.
• If you do not join within 15 minutes of the scheduled start time, the class will be automatically marked as missed and cannot be rescheduled.
• Every teacher has different availability for booking. You can view available slots after selecting a teacher.
• You must have an active subscription to book new classes. However, if you already booked sessions before your subscription ended, you may still attend those scheduled classes.
• Only 3-month and 12-month subscription plans include the option to reschedule classes.
• Rescheduling limits:
  • 3-month plan: Up to 6 classes can be rescheduled.
  • 12-month plan: Up to 36 classes can be rescheduled.
• Rescheduling is allowed only up to 5 hours before the class starts.
• Once a class is rescheduled, it cannot be rescheduled again.
• Booked classes cannot be canceled by the student.
• If Engage Speak cancels a booked class due to teacher unavailability, one complimentary class will be added to your account automatically.

8. Account Registration and Responsibilities

To use Engage Speak’s services, you are required to create an account. By registering, you agree to:

• Provide accurate, complete, and updated information during the registration process.
• Maintain only one user account per individual unless explicitly authorized.
• Use your account solely for personal, non-commercial educational purposes.
• Be fully responsible for all activity under your account.

9. Intellectual Property

All original content on Engage Speak—including text, graphics, logos, and instructional materials—is protected by copyright and intellectual property laws. We also use royalty-free content to enhance your experience. You may not reproduce, distribute, or modify any part of the platform without permission.

10. Limitation of Liability

Engage Speak is provided on an “as is” and “as available” basis. While we strive to offer reliable and uninterrupted service, we do not guarantee that the platform will always function without disruptions, delays, or errors.

We are not liable for:

• Temporary service interruptions or technical issues beyond our control.
• Errors, outages, or failures caused by third-party platforms or service providers.
• Any loss, damage, or inconvenience resulting from your misuse or misinterpretation of the content or services provided.

11. Changes to These Terms

We may revise these Terms of Use periodically. Any changes will be posted on this page with an updated effective date. By continuing to use Engage Speak after changes are posted, you agree to be bound by the revised Terms.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
